Rental Rules And Income

Last updated

A California city may require that an ADU be rented for terms longer than 30 days, which rules out typical short-term rental use. A city cannot require the owner to live on the property for an ADU, according to the HCD ADU Handbook (March 2026) and Government Code section 66315.

Rental Terms

A local agency may require that an ADU or JADU be rented for terms longer than 30 days, which rules out typical short-term rental use (HCD ADU Handbook (March 2026)). A JADU cannot be a short-term rental under Government Code section 66333. Check your city's ordinance and any home owners association rules before you plan to list a unit on a short-term rental site.

Owner Occupancy

Selling An ADU Separately

Most ADUs cannot be sold apart from the main home. A city may adopt an ordinance that lets the main home and ADU be sold as condominiums if it meets the conditions in Government Code section 66342. Ask your city if it has done so.

Lenders And Rental Income

Some loan programs allow expected or actual ADU rent to count toward qualifying income. The Freddie Mac ADU fact sheet and the handbook describe Freddie Mac and FHA rules that allow it, and the Fannie Mae ADU financing page covers Fannie Mae's ADU options. Each lender sets its own method, so ask. See ADU Financing.

Questions To Settle Before You Build

  1. Will the unit be for family first and rented later, or the reverse?
  2. Who pays utilities, and does the unit need its own meter?
  3. Does your insurance policy cover a rented second unit, and does the landlord liability need a separate policy?
  4. Do local or state tenant protection laws apply to your unit? Ask a housing attorney or your city.
  5. How will rental income be taxed? A tax professional can answer.

No Income Promises

Anyone who quotes you a set rent or a payback period without knowing your address is selling, not informing. Compare asking rents for similar units near your lot, and subtract property taxes, insurance, maintenance, vacancy, and loan payments.

Common Questions

Can I use my ADU as an Airbnb in California?

Often not. A local agency may require rental terms longer than 30 days, and a JADU cannot be a short-term rental at all (Government Code section 66333). Check your city ordinance and any home owners association rules.

Do I have to live on the property to rent my ADU?

No. For an ADU, a city cannot require owner occupancy (Government Code section 66315). A JADU that shares a bathroom with the main home is the exception.

Can I sell my ADU separately from the house?

Only if your city has adopted an ordinance allowing the main home and ADU to be sold as condominiums under Government Code section 66342. Ask your city whether it has.
